Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Boundtracks app or website, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. The Service

Boundtracks provides a mobile application that offers audio albums based on classic literary and philosophical texts (“albumbooks”). Content is available in free and subscription tiers as described below.

3. Free Tier and Subscription

Free access: Users may listen to the first three chapters of any title without a subscription.

Boundtracks Pro: Full access to all chapters and all titles requires an active Boundtracks Pro subscription. Subscription plans are offered on monthly, three-month, and annual terms.

Free trial: Eligible new users may receive a free trial period as offered at the time of sign-up. Trial eligibility is determined by Apple App Store and Google Play Store rules. Only one free trial is available per Apple ID or Google account.

Billing: Subscriptions are billed through the Apple App Store or Google Play Store, depending on the platform you use. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by applicable law.

Price changes: We reserve the right to change subscription pricing. You will be notified in advance of any price change and will have the opportunity to cancel before the new price takes effect.

4. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hi@boundtracks.fm if you suspect unauthorised access.

You must provide accurate information when creating your account. Accounts are for personal, non-commercial use only. You may not share your account with others or create accounts by automated means.

5. Content and Intellectual Property

All audio content, artwork, and software in the Boundtracks app is owned by or licensed to Boundtracks and is protected by copyright and other intellectual property laws.

Source texts used in Boundtracks albumbooks are in the public domain. The original recordings, arrangements, and productions are the exclusive property of Boundtracks.

You may not copy, reproduce, distribute, publicly perform, or create derivative works from any Boundtracks content without our express written permission.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated tools to access or scrape the service
• Interfere with or disrupt the service or its servers
• Attempt to gain unauthorised access to any part of the service
• Share, redistribute, or resell access to the service

7. Availability and Changes

We aim to keep Boundtracks available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time, with or without notice.

We reserve the right to add, remove, or modify content in the library at any time. Removal of content from the library does not entitle subscribers to a refund.

8. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Boundtracks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service.

Our total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid to us in the twelve months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law and Disputes

These Terms are governed by the laws of Portugal, without regard to conflict of law principles. Any dispute arising from these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Portugal, except where mandatory consumer protection laws in your country of residence require otherwise.

If you are an EU consumer, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via the app or by email. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
